Terms of Service

These Terms of Service ("Terms") govern your use of the ToTrain mobile application and website (collectively, the "Service"), operated by ToTrain, registered under KVK number 80183719 in the Netherlands ("we", "us", or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 16 years old and located in the European Economic Area, you must have verifiable consent from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately at info@totrain.app if you suspect unauthorized access to your account.
  • You may not create accounts for others without their permission.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code or content
  • Scrape, crawl, or use automated tools to extract data from the Service
  • Impersonate another person or misrepresent your identity
  • Use the Service to harass, abuse, or harm others

4. Health & Fitness Disclaimer

The Service is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • Training recommendations, including those from our AI coaching features, are for informational and educational purposes only.
  • Always consult a qualified healthcare professional before starting a new exercise program, especially if you have pre-existing health conditions.
  • You exercise at your own risk. We are not liable for injuries or health issues resulting from following training recommendations provided through the Service.
  • AI coaching features provide general guidance based on your data but cannot replace professional medical or fitness advice.

5. User Content

You retain ownership of content you submit through the Service (workout logs, profile information, photos, etc.). By submitting content, you grant us a limited, non-exclusive license to use, store, and process it solely to provide and improve the Service.

You are responsible for the content you submit and must not upload content that is illegal, harmful, or infringes on third-party rights.

6. AI Coaching Features

Our Service includes AI-powered coaching features that use your workout data and preferences to generate personalized training recommendations. By using these features:

  • You consent to your data being processed by our AI provider (Anthropic) for the purpose of generating recommendations.
  • You understand that AI recommendations are generated automatically and may not always be accurate or appropriate for your situation.
  • You acknowledge that AI coaching does not replace professional fitness instruction or medical advice.

7. Paid Features & Subscriptions

  • Certain features of the Service may require a paid subscription. Pricing and terms will be clearly displayed before purchase.
  • Subscriptions purchased through the Apple App Store or Google Play Store are subject to the respective store's billing and refund policies.
  • We may change subscription pricing with reasonable notice. Existing subscriptions will continue at their current price until the next renewal.
  • You may cancel your subscription at any time. Access to paid features continues until the end of the current billing period.

8. Intellectual Property

The Service, including its design, code, features, and content (excluding user content), is owned by ToTrain and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

9. Termination

  • You may delete your account at any time through the app settings or by contacting us at info@totrain.app.
  • We may suspend or terminate your account if you violate these Terms, with notice where reasonable.
  • Upon termination, your right to use the Service ceases immediately. Your data will be handled according to our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
  • Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

11. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Service will be submitted to the competent courts in the Netherlands.

If you are a consumer in the EU, you also have the right to submit a complaint through the EU Online Dispute Resolution platform.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
